Copyright (DMCA) Policy

NRIBay respects the intellectual-property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act (17 U.S.C. Β§ 512, the "DMCA"), we will respond promptly to valid notices of alleged copyright infringement and will terminate the accounts of repeat infringers.

1. Filing a DMCA takedown notice

If you believe content on NRIBay infringes your copyright, send a written notice to our designated agent containing all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the infringing material and its location on the Service (a direct link to the listing or content);
  4. Your contact information β€” name, address, telephone number, and email address;
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Please note that under 17 U.S.C. Β§ 512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.

2. Counter-notification

If your content was removed and you believe the removal was a mistake or misidentification, you may send a counter-notice to the same designated agent containing:

  1. Your physical or electronic signature;
  2. Identification of the removed material and where it appeared before removal;
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your judicial district (or, if outside the U.S., any judicial district in which NRIBay may be found) and that you will accept service of process from the person who filed the original notice.

If we receive a valid counter-notice, we may restore the removed material in 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the alleged infringement.

3. Repeat infringers

We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

4. Trademark and other IP complaints

For trademark infringement or other intellectual-property complaints (for example, counterfeit goods), contact us through the same channels with details of your rights and the infringing listing. Counterfeit items are also banned under our Prohibited Items & Posting Rules.
